Public Discussion of the Draft Constitutional Law of the Republic of Vestina “On Democracy and Public Governance”

For public discussion, the Draft Law of the Republic of Vestina “On Measures to Ensure the Implementation of the English Language as an Integrative Tool in the Activities of State Bodies” is submitted. “On Democracy and Public Governance.”

Discussion period: from November 15 to November 23, 2025.


DRAFT CONSTITUTIONAL LAW OF THE REPUBLIC OF VESTINA “ON DEMOCRACY AND PUBLIC GOVERNANCE”

Guided by the principles of popular sovereignty, transparency, and digital participation, and recognizing the importance of public governance as the foundation for the sustainable development of the Digital State, the Republic of Vestina adopts this Constitutional Law, which defines the foundations of democracy and the mechanisms for citizen participation in state decision-making.

CHAPTER I. GENERAL PROVISIONS

Article 1. Purpose and Scope of Regulation
This Law defines the legal foundations of democracy, the forms and principles of public governance, as well as the procedures for the participation of citizens and civil society institutions in the administration of the affairs of the Republic of Vestina.

Article 2. Fundamental Principles of Democracy in the Republic of Vestina

  1. The people are the sole source of state power.
  2. Democracy in the Republic of Vestina is exercised through the free will of citizens, digital participation, and a system of representative bodies.
  3. State authority is based on the principles of transparency, accountability, and feedback with society.
  4. Any decision of the state authorities is subject to public oversight in a digital format.

Article 3. Forms of Democracy Implementation

  1. Direct democracy is exercised through:
    1. digital referendums;
    2. public initiatives;
    3. digital consultations;
    4. votings in the “Civic Participation” system.
  2. Representative democracy is implemented through the elections of the President, the Garatsium, and other elected bodies.

CHAPTER II. PUBLIC GOVERNANCE

Article 4. Concept of Public Governance
Public governance is a system of joint participation by the state and citizens in the formation, implementation, and evaluation of the policies of the Republic of Vestina.

Article 5. Principles of Public Governance

  1. Openness and accessibility of information.
  2. Participation of citizens and civil society institutions.
  3. Digital transparency of procedures.
  4. Accountability of officials for governance outcomes.
  5. Ethical standards of digital interaction.

Article 6. Public Governance Bodies

  1. Public governance bodies include:
    1. Governorships;
    2. Garacium
    3. Public councils under state bodies;
    4. Digital citizen forums.
  2. Their activities are aimed at ensuring dialogue between the authorities and society.

Article 7. Public Consultations

  1. Every draft law or presidential decree with the force of law is subject to mandatory public discussion on the official digital platform.
  2. The public discussion period shall not be less than 5 calendar days.
  3. The results of the discussion are mandatory for consideration by the issuing authority.

CHAPTER III. CIVIC PARTICIPATION
Article 8. Right to Participation
Every citizen of Vestina has the right to:

  1. submit proposals and initiatives through digital platforms;
  2. participate in votings and surveys;
  3. observe the decision-making process;
  4. submit public inquiries.

Article 9. Public Initiatives

  1. An initiative that has gathered at least 1,000 digital signatures from citizens is subject to mandatory consideration by state authorities.
  2. The response to each initiative is published in open access.

CHAPTER IV. TRANSPARENCY AND DIGITAL ACCOUNTABILITY
Article 10. Digital Openness of Government

  1. All decisions of government authorities are published in the Registry of Legal Acts of the Republic of Vestina.
  2. Each act is accompanied by a QR code confirming its authenticity.

Article 11. Accountability of Officials

  1. Officials are required to publish a digital report on their activities annually.
  2. Reports are subject to public evaluation through the feedback system.
