PETITION
of the President of the Republic of Vestina
on the Constitutional Review of Certain Provisions of Article 10 of the Constitution of the Republic of Vestina

I, the President of the Republic of Vestina, acting in accordance with the powers vested in me by the Constitution of the Republic of Vestina,and guided by the objectives of ensuring the supremacy of constitutional law, the stability of the state system, and the protection of the rights and freedoms of the citizens of the Republic, do hereby petition the Constitutional Arbitrum of Justiarum of the Republic of Vestina to conduct an official constitutional review of specific norms of Article 10 of the Constitution of the Republic of Vestina, which governs the legal status and powers of the President of the Republic

SUBJECT OF THE PETITION
The subject of this petition is Article 10 of the Constitution of the Republic of Vestina — "The President of the Republic of Vestina" — which establishes the constitutional and legal status of the Head of State, the scope of his powers, the procedure for their exercise, as well as the limits of interaction with other bodies of state power.

In particular, I request that the Constitutional Arbitrum of Justiarum conduct an official constitutional review of the following aspects of Article 10:

1. 1. The scope and limits of presidential powers:the consistency of the literal wording of Article 10 with a systematic interpretation of the Constitution as a whole; the presence or absence of conflicts between specific parts of the Article and other constitutional provisions;
2. Delimitation of powers:Issues concerning the delimitation of competence between the President of the Republic and other high bodies of state power — the Parliament, the Government, and the judiciary — in cases that are not explicitly regulated or allow for ambiguous interpretation;
3. Constitutional guarantees and accountability:the consistency of Article 10 provisions regarding the guarantees of presidential activities and mechanisms of constitutional liability with the principles of the rule of law and proportionality;
4. Procedure for succession:the constitutionality of provisions governing the temporary exercise of presidential duties and the transfer of presidential powers under exceptional circumstances;
5. Norms on immunity:the constitutional substance of presidential immunity and its relationship to the principles of equality before the law and due process of law.

SPECIFIC QUESTIONS SUBMITTED FOR CONSIDERATION
Based on the foregoing, I request the Constitutional Arbitrum of Justiarum to issue an official opinion on the following questions:

1. Whether the literal interpretation of the provisions of Article 10 of the Constitution is consistent with the systematic meaning of the constitutional order of the Republic of Vestina regarding the scope of the President's powers?
2. Whether the requirements imposed on the President (or a presidential candidate) comply with international standards and the principle of equality?
3. Whether there are normative contradictions or legal gaps between the provisions of Article 10 and related constitutional norms governing the activities of other high bodies of state power?
4. What are the constitutional limits of the President's discretionary powers in cases not explicitly regulated by the Constitution?
5. Whether the current constitutional mechanism for succession to the Office of the President complies with the principles of the continuity of government and constitutional legality?
6. Whether the constitutional norms regarding presidential immunity are proportionate to the general principles of the rule of law as enshrined in the Constitution of the Republic of Vestina?

Based on the foregoing, and guided by the provisions of the Constitution and the Rules of Procedure of the Constitutional Arbitrum of Justiarum of the Republic of Vestina,

I HEREBY REQUEST:

1. To admit this petition for consideration and to conduct an official constitutional review of the provisions of Article 10 of the Constitution of the Republic of Vestina regarding the issues set forth in this petition;
2. To issue an official Opinion of the Constitutional Arbitrum of Justiarum,containing a normative interpretation of the relevant provisions of Article 10 of the Constitution, which shall be binding upon all bodies of state power and officials of the Republic of Vestina;
3. In the event that constitutional conflicts or gaps are identified, to include in the opinion appropriate recommendations to the legislative bodies of the Republic for the rectification of the identified inconsistencies;
4. To consider this petition on a priority basis, given its significance for ensuring the constitutional rule of law and the stability of state administration in the Republic of Vestina.
